IBS [2025] HKCFI 227 involves an application by the plaintiffs (C1, C2, C3 and a school IBS) to set aside declarations made by an arbitral tribunal in a counterclaim. The arbitration was initiated by China Publishing Group (CPG) against International Business School (IBS), with IBS counterclaiming against CPG and the plaintiffs. The dispute centres around a set of 2007 Agreements, including a Share Purchase Agreement, Investors' Rights Agreement, Voting Agreement and Share Restriction Agreement, made between CPG, three investment funds (C1, C2, C3) and a foundation that later assigned its rights to IBS.
