Governing law and dispute resolution provisions are all too often treated as "boiler plate clauses" and, unfortunately, it is not uncommon for contracting parties to pay them scant attention. Unclear drafting or a lack of consideration of litigation/arbitration strategy at the time of contract negotiation can lead to serious consequences if and when a dispute does arise. Adding further complication is an increasing trend towards complex dispute resolution clauses, which do not always work in the way they were intended.

During this one-hour breakfast seminar, Partner Robert Rhoda and Associate Fiona So will highlight the areas which should be considered when drafting dispute resolution clauses (whether court jurisdiction clauses or arbitration agreements), as well as the implications of the recent Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Proceedings by the Courts of the Mainland and of the Hong Kong Special Administrative Region.

They will also give practical advice on drafting techniques with reference to recent case law and answer any questions you may have about drafting dispute resolution clauses. This session should be of interest to in house counsel who are looking to achieve certainty with their drafting and to minimise the risk of their jurisdiction and arbitration clauses giving rise themselves to unwanted satellite disputes.
